قاروب لـ «عكاظ»: لو كنت صاحب قرار لقاضيت المعترضين – أخبار السعودية

في ظل الجدل الذي رافق إعلان أسماء المرشحين المستبعدين من سباق رئاسة الاتحاد السعودي لكرة القدم، ووسط تساؤلات الشارع الرياضي حول قانونية الإجراءات والمعايير المطبقة، كان لا بد من استطلاع رأي قانوني متخصص لفك طلاسم المشهد الانتخابي الحالي.

رئيس الجمعية الدولية لقانون الرياضة والعضو السابق باللجنة القانونية لـ«فيفا» المحامي ماجد قاروب، يضع النقاط على الحروف في حواره لـ«عكاظ»، ويتحدث بصراحة عن مدى قانونية أسباب الاستبعاد، وحظوظ المرشحين في الطعن، ودلالات تقليص شرط الخبرة، واختبار اللغة، وآلية التحكيم المعتمدة.

قاروب يرى، أن العملية الانتخابية «عادية» وتسير وفق أنظمة معلنة للجميع، وأن أي طعن يجب أن يستند إلى مخالفة فعلية وليس اعتراضاً على الشروط ذاتها، كما شدد على أن المرحلة الحالية تتطلب «دماء جديدة» تواكب رؤية 2030.

• هل ترى أن الأسباب التي أدت إلى استبعاد بعض المرشحين من سباق رئاسة الاتحاد السعودي قانونية؟

•• نحن أمام عملية انتخابية عادية تماماً، متوفرة فيها جميع الشروط والقوانين التي تكفل وتضمن لها النجاح، وكما رأينا أن القوانين والتشريعات والأنظمة الخاصة بانتخابات اتحاد القدم معروفة ومعلومة لدى الجميع، ومتاحة على الموقع الرسمي للاتحاد السعودي لكرة القدم، وهذا بحد ذاته أهم عوامل نجاحها وسيرها في الاتجاه الصحيح، وطالبت، في وقت سابق الأمير نواف بن فيصل، بوضع 5 أصوات للجنة الأولمبية في عضوية الجمعية العمومية لتعزيز الكفاءات المهنية والعلمية، ومجلس إدارة أحمد عيد هو أفضل إدارة قادت اتحاد القدم، من وجهة نظري حتى اليوم.

• ما أبرز الطعون التي من الممكن الدفع بها؟

•• المرشحون المستبعدون أعلم بحالهم، فكل مرشح يصله خطاب خاص يوضح له أسباب استبعاده، ومن خلال المستشار القانوني الخاص به – إذا كان لديه مستشار قانوني – يستطيع أن يقدم رداً على ذلك.

• هل تنصح المستبعدين من سباق الترشح بالطعن في عدم ترشيحهم؟

•• كما ذكرت لك، هو يستطيع ذلك حسب ما لديه من دفوع ومواقف قانونية يملكها في ملفه، لأنه هو من يعلم ماذا قدم وما لديه من نقص.

• مَن مِن المرشحين المستبعدين يستطيع العودة للسباق ولديه أسباب أقوى تدعم موقفه؟

•• كلهم لديهم القدرة على الاستئناف، وهذا حق كفلته لهم أنظمة الانتخابات بنظامها الحالي الذي تم توضيحه للجميع، ولكن أنا لا أستطيع تحديد من منهم يملك الوضع القانوني الأقوى أو الأضعف، لأنني لم أطلع على ملفاتهم، ولا أحكم من خلال ما يرد في وسائل الإعلام.

• هل يحق للمرشحين المستبعدين اختيار المحكمين الذين يرغبونهم؟

•• إذا كان هذا معلناً مسبقاً من خلال أنظمة الاتحاد السعودي لكرة القدم وفي ما يخص الانتخابات فهو قانوني ونظامي، لأنهم أصلاً من ضمن المحكمين ويحق للمرشحين اختيار محكم من الثلاثة فقط.

• هل وجود عدد محدود من المحكمين في مثل هذه الحالات أمر معتاد بالنظر إلى عامل الوقت، في ظل المواعيد الزمنية المحددة؟

•• نعم أمر معتاد، لسببين الأول كونه معلناً مسبقاً، والثاني لأنها انتخابات مؤقتة ووقتها محدود، لذلك تم الإعلان المسبق عن العدد وحصرهم في ثلاثة محكمين، وأنا أرى أن اختيار ثلاثة محكمين للفصل في الطعون المقدمة من المرشحين من قبل غرفة التحكيم الرياضي تم الإعلان عنه بوقت كافٍ، وهو من ضمن الشروط والضوابط الخاصة بانتخابات اتحاد القدم التي أُعلن عنها مسبقاً، وبالتالي فأي محاولة لاستحداث جديد في أنظمتها وقوانينها يعتبر استخداماً واستهلاكاً إعلامياً مع الجمهور الرياضي.

• لماذا قُلص شرط الخبرة من 10 سنوات إلى سنتين؟

•• أولاً أريد أن أفصح بمعلومة لـ«عكاظ»، وهي أن شرط الخبرة الذي وُضع لمدة 10 سنوات كنت أنا والدكتور صالح بن ناصر من أوائل الذين وضعوه وشاركنا في ذلك، لأن الفترة الماضية كانت تحتاج رئيس اتحاد يملك الخبرة الكافية، بخلاف اليوم، فهذا الشرط تمت مراجعته كوننا اليوم نحتاج دماء جديدة وشابة ولديهم فكر مختلف يواكب رؤية 2030، وقد رأينا النجاحات التي قدمها رئيس النادي الأهلي ورئيس نادي القادسية واستطاعا خوض غمار منافسات هذه الانتخابات، ولو لم يحدّث الشرط لما استطاعا الترشح.

• هل برأيك يعتبر شرط اللغة الإنجليزية شرطاً أساسياً للمرشح في مباشرة أعماله رئيساً للاتحاد السعودي؟

•• الشرط موجود منذ مدة طويلة، ومعلن ضمن شروط وأنظمة انتخابات الاتحاد السعودي، والكل يعرفه ولا غبار عليه، لأننا نحتاج رئيساً يستطيع التعامل مع الاتحادات الأخرى، وفي «فيفا»، ولديه القدرة على تمثيل البلد أفضل تمثيل.

• هل الاستعانة بشركة بريطانية لإجراء اختبار اللغة الإنجليزية كانت سبباً في هذه الربكة؟

•• لا يوجد أي خلل في هذا الأمر، والاستعانة بشركة محايدة هو من الخطط السليمة والناجحة في مثل هذه الانتخابات، ولا توجد ربكة إلا عند الذين فهموا الموضوع بشكل خاطئ، فاللجنة أوكلت الأمر لأهل التخصص، وكلنا نتحدث اللغة الإنجليزية.. هناك لغة شارع، وأخرى للمطاعم، ولغة يستطيع الشخص أن يسيّر بها أموره، لكن اللغة المطلوبة في رئيس اتحاد القدم تحددها هذه الشركة المتخصصة في اللغة الإنجليزية.

• هل هناك خلل في البرنامج الانتخابي، كون المرشحين لم يتجاوزوا مراحل الترشيح؟

•• لا يعد خللاً أبداً، ولكن من يتم استبعاده فهذا يعود لوجود خلل في ملفه، وليس ذنب من لم يُستبعد فهو جهز ملفاً كاملاً استطاع من خلاله عبور مراحل هذه الانتخابات.

• هناك شرط في الانتخابات الحالية، وهو أنه لا يحق لأي عضو في الجمعية العمومية تزكية أكثر من قائمة انتخابية واحدة.. هل هذا الشرط يحتاج مراجعة؟

•• الذي لا يستطيع الحصول على ثلاث تزكيات هذا ليس له حضور في الوسط الرياضي، وغير قادر على التواصل مع 50 عضواً من أعضاء الجمعية العمومية، وبالتالي فإن الأمر يعود إليه وليس لأنظمة الانتخابات، وتلقيت اتصالات لدعم مرشحين ورفضت، لأن هذه ليست ممارسة انتخابية، وأستغرب من المرشحين الذين يعترضون على شروط الانتخابات وهم قبلوا بها من البداية، ولو كنت صاحب قرار لقاضيتهم في لجنة الانضباط.

In light of the controversy surrounding the announcement of the names of the candidates excluded from the race for the presidency of the Saudi Football Federation, and amidst questions from the sports community regarding the legality of the procedures and criteria applied, it was necessary to seek the opinion of a specialized legal expert to unravel the complexities of the current electoral scene.

The President of the International Association of Sports Law and former member of FIFA’s legal committee, lawyer Majid Qaroub, clarifies the details in his interview with “Okaz,” speaking candidly about the legality of the reasons for exclusion, the candidates’ chances of appeal, the implications of reducing the experience requirement, the language test, and the arbitration mechanism in place.

Qaroub believes that the electoral process is “normal” and proceeding according to publicly announced regulations, and that any appeal must be based on an actual violation rather than an objection to the conditions themselves. He emphasized that the current phase requires “new blood” to align with Vision 2030.

Here is the text of the interview:

• Do you believe that the reasons that led to the exclusion of some candidates from the race for the presidency of the Saudi Federation are legal?

•• We are facing a completely normal electoral process, with all the conditions and laws in place that guarantee its success. As we have seen, the laws, regulations, and systems related to the elections of the Football Federation are known and available to everyone, and accessible on the official website of the Saudi Football Federation. This, in itself, is one of the most important factors for its success and proper direction. I previously called on Prince Nawaf bin Faisal to allocate 5 votes for the Olympic Committee in the General Assembly membership to enhance professional and scientific competencies, and I believe that Ahmed Eid’s board is the best management that has led the Football Federation to date.

• What are the main appeals that could be raised?

•• The excluded candidates are aware of their situation, as each candidate receives a specific letter explaining the reasons for their exclusion, and through their legal advisor—if they have one—they can respond to that.

• Do you advise those excluded from the candidacy race to appeal their non-nomination?

•• As I mentioned, they can do so based on the defenses and legal positions they have in their files, because they know what they have presented and what deficiencies exist.

• Which of the excluded candidates can return to the race with stronger reasons supporting their position?

•• They all have the ability to appeal, and this is a right guaranteed to them by the current electoral system that has been clarified to everyone. However, I cannot determine who among them has the stronger or weaker legal standing, as I have not reviewed their files, nor do I judge based on what appears in the media.

• Are the excluded candidates entitled to choose the arbitrators they prefer?

•• If this was announced in advance through the regulations of the Saudi Football Federation regarding the elections, then it is legal and legitimate, as they are already among the arbitrators, and candidates have the right to choose one arbitrator from the three.

• Is having a limited number of arbitrators in such cases a common practice considering the time factor, given the set deadlines?

•• Yes, it is common for two reasons: first, because it was announced in advance, and second, because these are temporary elections with a limited time frame. Therefore, the number was announced in advance and limited to three arbitrators. I believe that the selection of three arbitrators to adjudicate the appeals submitted by the candidates by the Sports Arbitration Chamber was announced with sufficient time, and it is part of the conditions and regulations related to the elections of the Football Federation that were announced in advance. Thus, any attempt to introduce new elements into its systems and laws is considered a media consumption and exploitation with the sports audience.

• Why was the experience requirement reduced from 10 years to 2 years?

•• First, I want to disclose information to “Okaz,” which is that the experience requirement set for 10 years was established by me and Dr. Saleh bin Nasser, as we were among the first to set it and participated in that, because the previous period required a federation president with sufficient experience, unlike today. This condition has been reviewed because we now need new, young blood with a different mindset that aligns with Vision 2030. We have seen the successes achieved by the president of Al-Ahli Club and the president of Al-Qadisiyah Club, who were able to compete in these elections. If the condition had not been updated, they would not have been able to run.

• Do you believe that the English language requirement is essential for a candidate to carry out their duties as president of the Saudi Federation?

•• The requirement has been in place for a long time and is announced as part of the conditions and regulations of the Saudi Federation elections, and everyone knows it and there is no doubt about it, as we need a president who can communicate with other federations and with FIFA, and who has the ability to represent the country in the best way.

• Was the engagement of a British company to conduct the English language test a cause of this confusion?

•• There is no flaw in this matter, and engaging a neutral company is one of the sound and successful plans in such elections. There is no confusion except among those who misunderstood the issue. The committee entrusted the matter to specialists, and we all speak English… there is street language, restaurant language, and a language that a person can use to manage their affairs, but the language required for the president of the Football Federation is determined by this specialized English language company.

• Is there a flaw in the electoral program, given that the candidates did not pass the nomination stages?

•• It is not a flaw at all; rather, those who are excluded have a flaw in their files, and it is not the fault of those who were not excluded, as they prepared a complete file that enabled them to pass through the stages of these elections.

• There is a condition in the current elections that no member of the General Assembly may endorse more than one electoral list. Does this condition need to be reviewed?

•• Anyone who cannot obtain three endorsements does not have a presence in the sports community and is unable to communicate with 50 members of the General Assembly. Therefore, the issue is up to them and not the electoral regulations. I received calls to support candidates and refused, as this is not an electoral practice, and I am surprised by candidates who object to the election conditions while they accepted them from the beginning. If I were in a position to decide, I would have referred them to the Disciplinary Committee.
